PPSC LLC Disclaimers and Terms of Use

Limitation of Liability: Reliance on the information, content, and advice provided on the Site and through our services is at your sole risk. Pocono Pediatric Sleep Consulting LLC, including its members, managers, officers, employees, agents, and contractors, shall not be liable for any loss or injury, nor for any indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from any contract, negligence, strict liability, or any other theory related to: (i) your use of or inability to use the Site and/or services; (ii) any content available on the Site and/or services; (iii) statements or conduct publicly posted or made available on the Site and/or services; or (iv) any product or service purchased or obtained through the Site or services. Under no circumstances shall Pocono Pediatric Sleep Consulting LLC be liable for any claims, damages, injuries, losses, or expenses resulting from the use of the Site and services.

Confidentiality Policy: Pocono Pediatric Sleep Consulting, including its members, managers, officers, employees and contractors, is committed to fully maintaining the confidentiality of all client communications and information permitted by law. Personal information will not be disclosed without the explicit consent of the client. Exceptions to this policy include situations involving an imminent threat of serious harm to any client, child or children, or other individuals within the household. As a company serving families with minors, we are mandated reporters and will report any suspected or observed abuse or neglect of a minor, as well as any imminent threat to household members during our professional engagement.

 

General: These terms of use and confidentiality policies are governed by and interpreted in accordance with the laws of the Commonwealth of PA. Pediatric Sleep Consulting LLC may amend or modify these terms of use at any time.

 

Copyright Notice: All information and content on this site and its services are the exclusive property of Pocono Pediatric Sleep Consulting LLC. Reproduction, publication, or transmission in any form: mechanical or electronics is prohibited without written consent. This includes, but is not limited to, sleep plans, e-guides, charts, notes, advice, transcripts, summaries, and forum posts. All such materials are confidential and sharing them is subject to U.S. copyright law.

 

Medical Disclaimer: Pocono Pediatric Sleep Consulting LLC is committed to enhancing sleep quality for infants and young children. We do not provide medical advice to families, including but not limited to concerns related to feeding or any diagnosed or undiagnosed developmental or physical conditions. Families seeking medical advice or treatment should promptly consult their child's pediatrician.

Additionally, we do not endorse the Cry It Out Sleep Training Method due to potential, unidentified health risks associated with its use in infants and young children.

 

Refund Policy: Pocono Pediatric Sleep Consultants LLC reserves the right to revise or modify this policy at its discretion. The refund policy in effect at the time of purchase will be honored for the duration of the client's contracted period. Please note that our sleep consultants are professionally trained and experienced individuals who work diligently to enhance the sleep quality of young children.

Due to the time, effort and commitment to our clients provided during consultations and for services we are not offering full refunds with the following exceptions.

A purchase was made: Full refund if one of the following two conditions has occurred

  1. If, within the first 24 hours, the client decides not to proceed with a consultation or does not provide assessment intake information to the sleep consultant.  

2  If more than 24 hours have passed and an initial consultation has not been scheduled or conducted, and the client has not completed the intake questionnaire.
 

Partial Refund: A partial refund may be considered if approved by Pocono Pediatric Sleep Consulting LLC officer approves.  One of the following conditions has been met.

1. If an initial consultation and assessment have been conducted, but the plan has not yet been provided to the client either electronically or by mail, a 50% refund may be granted

2. If, after  at least three separate weeks in which the client's child has started and had to stop or postpone the sleep training plan due to illness or other reasonable reasons, and the consultant has actively participated with the family either in person or via video call—while agreeing that the client has followed the collaboratively developed plan involving both the client and child—and there is no improvement observed in daytime naps (in terms of independent sleeping or nap duration), evening bedtime routines (with fewer sleep props or increased independence), or overnight sleep periods, then up to a 50% refund may be possible. Any documentation provided by the client in text, email, or through an app used for record keeping, as noted by the consultant during the sleep training process, indicating any improvement will void the refund request. Please keep in mind a professionally trained  and trusted sleep consultant who has worked with the family. These are dedicated people doing their job to improve the sleep of young children.

 Any other refund request will be reviewed independently by the officers of Pocono Pediatric Sleep Consulting LLC and will be based on their discretion.   

Terms & Conditions - the basics

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner. 

 

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).     

 

T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.

What to include in the T&C document

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
